Riding four wheelers in a private subdivision on the road?
I live in an enclosed subdivision outside of the city limits in West Monroe Louisiana and I have been told by 2 Sheriff department officers that it is not illegal to drive an ATV vehicle in the subdivision because it only has one outlet. Is this trus and if so, where can I get a copy of this legal document stating this fact. Thanks
There are a couple of questions that you need to answer. Are the streets private property, or public streets/highways? Even if privately owned, the streets could be “dedicated” public “right-of-ways”. What does the state law say about privately owned land, common property of a private subdivision and the definition of public streets and right-of-ways?
You will need to check the laws first see what is allowed, or not allowed. Then check the deeds and land records to answer what laws applies to your subdivision.
There is no single document that will answer all these questions. I think the matter is covered by several different parts of the legal system, Administrative Law, Vehicle Code and Land/Property Law.
For a start try the vehicle code for LA.
But if the sheriff says it is legal, why ask further.
