File Format
The original songs have been encoded using FairPlay-encrypted 128 kbit / s AAC streams in an MP4 container, with M4P extension ..
Although the licenses for the AAC compression and the MP4 file format are readily available, Apple has not been generally committed to license its proprietary encryption system FairPlay to other manufacturers of mobile devices, so Apple is in able to play Fairplay-encrypted songs sold on the iTunes Store. The only exceptions were three mobile phones sold by Motorola in 20.056 years: Motorola ROKR E1, Motorola RAZR V3i and SLVR L7 Motorola.
Currently, digital booklets included with some albums are in PDF format. With the software current iPod, these files can not be read iPods.
On May 29, 2007 EMI tracks are available in a format without DRM unless called iTunes Plus. These files are not protected and are encoded AAC 256 kbps, twice the speed of standard tracks bought through the service. They are labeled "buy AAC audio file" (. M4a) instead of "protected AAC audio file (. M4P) on iTunes and includes the context menu by right clicking on an option to convert songs to MP3. In January 2009, Apple announced that all music will be available in iTunes Plus format, terminate the sale of music without DRM on iTunes.
In April, sales of protected music finished in the western versions of the store, so all the music on the iTunes Store "iTunes Plus". Some music videos are also available "ITunes Plus", which give a bit more audio and video bit rate. iTunes Store users can choose "Upgrade" one of its iTunes music downloads on iTunes Plus, if they wish, but most songs do require payment. music FairPlay DRM is available the iTunes Store in Japan.
In September 2009, Apple introduced the iTunes format LP (formerly known as payment by the codename "Cocktail") that provides visual content and interactive, along the tracks of the album and lyrics.
Digital Rights Management
IPod white combination of fifth generation. The only handheld devices allowed to play copyrighted music on the iTunes Store are iPods, iPhone, iPod Touch and some Motorola mobile phones like the ROKR.
Apple's FairPlay digital rights management (DRM) is integrated into iTunes, which manages songs purchased the iTunes Store. iTunes FairPlay to implement three major limitations:
Users can make a maximum of seven CD copies of a list of topics he contains such songs purchased from the iTunes Store.
Users can access their purchased songs on up to five computers.
Songs can be played on a computer with iTunes or an iPod, other MP3 players are not compatible with FairPlay encoded tracks.
There is no restriction on the number of iPods purchased a song can be transferred nor the number of times each individual song can be burned to a CD.
When Apple initially introduced Fairplay, songs purchased through iTunes had limits of three machines and ten simultaneous CD copies of a playlist. Setting the current limit is achieved with the introduction of iTunes 4.5 in April 2004, presumably as a result of renegotiations with Apple had majors.
Apple's DRM technology is fragile. Several programs were written to remove the envelope and let the FairPlay AAC files for use without technological restrictions. More simply, a user can convert protected files to unprotected MP3 format on fire, ripping CDs to iTunes. (Some Audio quality is lost in this transcoding from one format to another loss, but CDs are lossless, usually at the end and beginning formats are both at a loss) An alternative, but also with loss, how to transcode the files is to record "Wave Out Mix" with a registration program audio (like Audacity or Audio Hijack Pro) while playing the song in iTunes and then encode into a format of choice for users.
Competitors accuse Apple using iPod, the iTunes Store, and "FairPlay" to establish a vertical monopoly and lock-in for iPod users with the iTunes store exclusively (and vice versa). This "block" has two aspects:
Apple has maintained tight control of its FairPlay encryption. Other online music stores can not sell music files encoded with FairPlay, and competing products from companies like Creative Labs and iRiver can not play these files. This means that consumers who want to listen to songs downloaded iTunes Store or you need an iPod or convert the files in an open format.
IPod can not play files encoded in Microsoft's WMA format and protected propeller RealNetworks used by other online music stores. the iPod owners who want to play music from other stores should circumvent the DRM files.
In July 2004, RealNetworks launched a program called Harmony, which converts files purchased from RealNetworks' RealRhapsody service into a FairPlay-compatible format that an iPod could play. In response, Apple accused RealNetworks of "adopt the tactics and ethics of a hacker to break into the iPod." and published a firmware update iPods ineligible to play these files. On January 3, 2005, a client iTunes Music Store Apple has filed a lawsuit alleging the company has violated U.S. antitrust laws by freezing competitors.
In 2006, controversy erupted over a French bill to strengthen protection works of art against "piracy" or illegal copying, some clauses of the law could be used to request Apple to provide information on their FairPlay system to manufacturers of competitive players. Apple and advocacy groups protested against the bill, even going so far suggest that condoned "state-sponsored piracy." Some American commentators argued that the law was a protectionist measure cons iPods.
Movement against DRM
On February 6, 2007, Steve Jobs, called the four major record labels to allow their music to be sold without DRM. On April 2, 2007, Apple and EMI announced that the iTunes Store starts to offer as an option to purchase additional securities from the EMI catalog, encoded AAC 256 kbps without FairPlay DRM or another.
On May 29, 2007, Apple released version 7.2 of its iTunes software, allowing users to buy DRM-free music and video clips of the participation of labels. These new files are available on the iTunes Store, iTunes has been called in addition to music from Apple.
In October 2007, iTunes Plus was no longer an option purchase. Instead, it became automatic for all content in iTunes Plus license. In addition, the price of iTunes Plus DRM prices reversed.
Almost immediately after the launch of iTunes Plus, it was reported that the slopes sold without DRM from the iTunes Store contains information that identifies the customer, integration of the full name of account and buying e-mail as metadata in the file. Although this information has always been in iTunes downloads without DRM Fairplay is believed to remain on the slopes as a measure to determine Originally securities illegally shared online, the lack of DRM now provides. Privacy groups are concerned that these data could be hurt if you take the possessions of the files were stolen, and incriminating a potentially bad user for breach of copyright.
On 6 January 2009 at Macworld Expo, Apple announced a major revision of the iTunes catalog Plus with Universal Music Group, Sony BMG, Warner Music Group and EMI's offer More music in iTunes immediately. Since the announcement, 8 million songs are available DRM-free formats for Apple. From April 2009 all the titles are now available iTunes Plus format, with the exception of the Japanese iTunes store.

Litigation
Apple Records
Main article: Apple Corps against Apple Computer
For three years, the Beatles record label Apple Records have been in a legal dispute, Apple Corps against Apple Computer, Apple Computer with the name "Apple". On May 8, 2006, a decision was in favor of Apple Computer, but Apple Records, said he would appeal the decision. However, plans were announced by Neil Aspinall in April 2006 and completely remastered and the release of the entire Beatles catalog in a music service line is not specified, and the release of some works never before imagined by the band. No date has been set. He also was reported that the Beatles catalog, music can be a principle that seems only on iTunes, because Apple has been reported to trading with the British group EMI through a distribution agreement online that could be unique for a limited time. At its January 9, 2007 Speech Macworld, Steve Jobs used the song by "Lovely Rita" to enter the reading skills of the new iPhone music company. This was seen by observers as further evidence that the catalog of the Beatles catalog was introduced iTunes Music Store in the near future. February 5, 2007, Apple Corps and Apple Inc. announced that they had reached an agreement in their legal dispute. In a related development, Apple announced on August 14 2007 that the solo catalog of all John Lennon will be available on iTunes. The solo catalogs of the other three Beatles, Paul McCartney, Ringo Starr and George Harrison are also available on iTunes. Although officials of the Beatles catalog is not yet available, some of his works are available various artists.
The challenge for consumers Council of Norway EULA
On June 6, 2006, mediators of consumption in Norway, Sweden and Denmark launched a joint open letter to Apple regarding the EULA of iTunes through the Norwegian Consumer Ombudsman Bjoern Erik Thon. If iTunes is based on an official complaint lodged by the Council consumption in Norway January 25, 2006.
The main complaints were:
The EULA is disproportionate to the customer disapproval. Scandinavian law requires the written consent of both parties. The weaker party also enjoys protection against exploitation Consumer law in Norway.
Using iTunes Store DRM restricts the number of devices purchased songs can be played on.
iTunes contract allows the company to change at any time the terms of the contract without notice, including the selection of players or software used for iTunes files, and the number of times a customer can modify or copy files and purchased.
The EULA is both vague and confusing customers.
The EULA that the legal relationship between the company and customers is regulated by English contract law. It is unreasonable to expect Consumer Norway has a vast knowledge of English law. Products marketed to Norwegian consumers in Norway are subject to Norwegian law, a right which can not waive a clause in the contract of a standard enterprise client.
The EULA removes responsibility from iTunes to affect the consumer's computer software bugs due to, but responsibility can not be binding in the Scandinavian law.
Apple responded July 31, 2006.
On January 22, 2007, German consumers groups and French joined forces with Norway and Finland. Its objective is to create a united front against iTunes in Europe (Germany and France have had their own negotiating process with iTunes). According to the press release from Apple in favor of it. Key points of the negotiations were:
Interoperability, the consumer should have the right and ability to play music on any device of their choice.
Changing conditions iTunes should revoke the right to change their Terms and Conditions (EULA) at any time without the consent of the consumer.
iTunes must change its liability disclaimer to recover damages for consumers if they are caused by content sold through iTunes.
Consumer law applicable to sign a contract with iTunes should be able to count in the rules of consumer protection in accordance the law of the country in which they live.
For anti-trust the EU
In 2004, What? European Commission magazine complained of rising prices the United Kingdom for the same songs sold in the EU. Normally € 0.99 in the EU and 79 pence in the UK. In 2008, the Commission withdrew its investigation after Apple agreed to end price discrimination.
Conflict content
Universal Music Group
On July 1, 2007, the New York Times reported that Universal (currently the world leader in music the most important) would not renew his contract annual sales of music via iTunes. Instead, Universal said her music market to Apple at will, allowing you to remove its songs from the iTunes service on short time if both parties were not agree on price or other conditions.
On August 9, 2007, UMG announced a plan to sell some songs in MP3 format without the direction of Digital rights through a variety of online services like Amazon MP3 and gbox-ups. While these issues are still available through the iTunes Store, Universal decided to license these songs without DRM formats as other services.
NBC Universal TV series
August 31, 2007, Apple announced the 2007-08 NBC programs on the television program is not available on iTunes. NBC had told Apple the day to renew his contract. It was clarified later that this change only applies to series produced by NBC Universal, owned by Universal Media Studios, including Universal produces shows on other networks such as the House of Representatives. NBC programs produced by other studies, such as Chuck (Warner Bros.) and "Journeyman" (20 Century Fox) may be available on iTunes.
Apple has said publicly that NBC has renewed his contract if Apple agreed to a price increase $ 4.99 U.S. per episode, what did not. NBC disputes this claim, citing that Apple is opposed to the request of NBC to package shows together and make it more flexible setting wholesale prices. NBC says it never asked to double the wholesale price and insisted that its programs are sold through the iTunes Store and early December. Other networks that sell its programs through iTunes does not follow, as some have predicted he would. [Citation needed] On December 1, 2007 NBC shows have been deleted from iTunes.
On September 9, 2008, Apple and NBC Universal announced that NBC shows on television is again available on the iTunes U.S. store.
The iTunes Store in the UK has many programs NBC, while being distributed by Universal Studios. The price of these stations is higher than what was in store for the United States, offering an example, Season 3 of The Office is priced at UK43.47 (about U.S. $ 72) from $ 52.99 (U.S. store HD).
